Assurance responsabilité civile - la condamnation pénale lie pleinement l'assureur, qu'il le veuille ou pas !

La Cour de cassation a rappelé à l'ordre un assureur de responsabilité civile qui essayait de limiter son obligation de couverture. En effet, la cour considère dans un arrêt du 12 mai 2005, que l'assureur ne peut pas se désister de ses obligations sous prétexte que la condamnation de l'assuré au paiement de dommages et intérêts avait été prononcée par une juridiction pénale et au cours d'une instance à laquelle il n'était pas partie. En effet selon l'article L. 388-1 du Code de procédure pénale, l'assureur RC ne peut intervenir à l'instance qu'en cas d'homicide ou de blessures involontaires. Or s'agissant de recel de vol et de violences, l'assureur refusait de payer la totalité de la somme demandé en invoquant le fait qu'il n'existait pas la possibilité pour lui de faire appel à la condamnation pénale, n'étant pas partie au procès. La Cour de cassation répond en se référant à l'article L. 113-5 du Code des assurances et donc au principe pure et simple de l'exécution du contrat par l'assureur dès lors que le risque couvert se réalise. L'assureur ne pourrait être exonéré de cette obligation qu'en cas de fraude à son encontre ! Une décision sévère mais qui met à l'abri les assurés des comportements souvent abusifs des assureurs en la matière ... !
